California Shoplifting Law: What the Charge Actually Means

California Penal Code 459.5 defines shoplifting as entering a commercial establishment during normal business hours with the intent to steal merchandise valued at $950 or less. The key word is intent. The prosecution must establish that you meant to steal the merchandise, not simply that merchandise left without payment.

Conduct that can support a shoplifting charge includes concealing items in clothing or bags, switching or altering price tags, manipulating the checkout process, returning merchandise you didn’t purchase, and walking out without paying. Under California law, you can be charged even if you never left the store, provided prosecutors can establish intent.

The $950 threshold determines the charge level. When merchandise value stays at or below $950, the charge is shoplifting under Penal Code 459.5 or petty theft under Penal Code 484. Once merchandise value exceeds $950, the charge escalates to grand theft, which can be prosecuted as either a misdemeanor or a felony. California law also bars prosecutors from charging both shoplifting and burglary for the same act.

Penalties: Misdemeanor, Felony, & the Effect of Propositions 47 & 36

Misdemeanor shoplifting carries up to six months in county jail, fines up to $1,000, and court-ordered restitution to the store. Felony grand theft can result in 16 months to three years in state prison and fines up to $10,000. Courts may also impose probation, community service, mandatory theft diversion classes, or participation in an Adult Offender Work Program as conditions of a plea or sentence.

Two ballot measures shape how California courts handle these charges today:

Proposition 47 (2014) classifies petty theft of property valued at $950 or less as a misdemeanor, even for defendants with prior theft convictions, unless those priors include registerable sex offenses or qualifying violent felonies under Penal Code 667(e)(2)(C)(iv).
Proposition 36 (effective late 2024) creates a wobbler for petty theft with two or more prior theft convictions, allowing felony prosecution depending on circumstances. It also authorizes enhanced penalties when aggregated stolen values across multiple incidents exceed the felony threshold and mandates judicial review of pre-trial release for repeat offenders.

Consequences Beyond the Sentence

The sentence is only part of what a conviction costs. Theft offenses are classified as crimes of moral turpitude under California law, a designation that triggers scrutiny across professional licensing boards and can affect applications and renewals in licensed trades and professions.

The consequences extend further:

Immigration: Non-citizens convicted of a theft crime may face deportation, denial of re-entry, or inadmissibility under federal immigration law.
Employment: Employers conducting background checks routinely screen for theft convictions and may decline applicants for roles involving money, inventory, or access to client information.
Housing: Landlords commonly screen for criminal history, and a theft conviction can affect rental housing applications.
Education: Student financial aid eligibility and college admissions can be affected depending on institutional policies.
Civil liability: Retailers may pursue civil damages separately from any criminal penalties.

Mistaken Identity

Surveillance footage and loss prevention testimony are fallible. We scrutinize how footage was preserved and handled, whether identification procedures were reliable, and whether the person charged was actually the person observed.

Illegal Search & Seizure

Evidence obtained without a lawful basis can be suppressed. When an unlawful stop, search, or seizure produced the evidence against you, we pursue suppression. Without that evidence, the prosecution’s case may be significantly weakened.

Claim of Right & Duress

A genuine belief that you had a right to the property negates the criminal intent element. If you were coerced or threatened into taking merchandise, duress may apply.
