A wrongful death in California occurs when a person dies because of negligence or a wrongful act caused by another individual or entity. The wrongful death lawsuit is brought to court by the deceased person’s surviving family members or personal representatives of his/her estate.
Eligibility to File a Wrongful Death Lawsuit in California
The following individuals can file a wrongful death claim in California on behalf of the deceased person:

- Domestic partner
- Children
If none of the parties mentioned above exist, anyone who would be entitled to the deceased person’s property and estate (e.g., parents or siblings) can file a lawsuit. If a parent, stepchild, or “putative” spouse or child had depended on the financial support of the deceased individual prior to his/her death, then these parties may file a wrongful death lawsuit. It is important to note that in California, the statute of limitations for a wrongful death claim must be initiated within two years from the date of death.

Our Experience with the Sawl Law Group was only positive.
